NEWS: MOJ RELEASES GUIDANCE FOR TERRIBLE TARIFFS AND PSYCHOLOGICAL INJURIES

On 5th August 2025 the MOJ Released its guidance on the Whiplash Tarrifs and associated psychological injuries. But there is nothing new to report since the increase confirmed March 2025.

The MOJ guidance covers: the application of the whiplash tariff for road traffic accident related personal injury claims for whiplash injuries occurring between 31 May 2021 and 30 May 2025, and those occurring on or after 31 May 2025; minor psychological injuries; and how to make a low-value personal injury claim following a road traffic accident.

COMMENT

Respectfully, the guidance contains nothing new for legal practitioners save for a reminder that the MOJ did not envision the need for more than 1 medical report when it came up with absolutely terrible idea of throwing >100 years of case law to the wind by introducing these terrible tariffs.


By way of a brief reminder, the tariffs were introduced by the then Conservative Government following intense lobbying from the insurance industry to cut compensation payments to injured claimants.


The same insurers donated very heavily to successive conservative party campaigns.
